Area man pleads no contest to trespass

A Swanton man pleaded no contest and was sentenced on Aug. 18 in the Fulton County Common Pleas Court.

Brad E, Smith, 37, pleaded no contest to Aggravated Trespass. According to Fulton County Prosecutor Scott A. Haselman, on or about June 7, 2016, Smith trespassed in an occupied structure in Swanton with purpose to commit a misdemeanor offense.

Judge James E. Barber sentenced Smith to one year of community control. He ordered Smith to pay prosecution costs and counsel fees; not consume or possess alcoholic beverages or illegal drugs; not enter bars or taverns; be assessed by a reputable dual diagnosis agency and successfully complete counseling if recommended; and seek and maintain employment.

Failure to abide by these conditions could result in Smith serving 180 days in jail.
